Affiliate Program Terms

These Affiliate Program Terms ("Terms") outline the terms and conditions for participation in the DemandEngine Affiliate Program ("Program"). By participating in the Program, you ("Affiliate") agree to comply with these Terms.

1. Participation in the Program

1.1 Eligibility: To participate in the Program, you must complete and submit an application. Acceptance into the Program is at the sole discretion of DemandEngine ("Company").

1.2 Program Access: Once approved, you will receive access to the Affiliate Dashboard, where you can track your referrals and commissions.

2. Affiliate Responsibilities

2.1 Promotion: You agree to promote the Company’s products and services using ethical and legal marketing practices.

2.2 Referral Link: You will use the unique referral link provided to you to track sales and calculate commissions.

2.3 Compliance: You must comply with all applicable laws and regulations in your marketing activities.

3. Commissions

3.1 Commission Structure: Commissions vary depending on the specific product or service sold. Details of the commission structure are available in the Affiliate Dashboard.

3.2 Payment Schedule: Commissions are held for 60 days and will be paid out at the beginning of the month following the 60-day hold period. This ensures that any returns or chargebacks are accounted for before payment is made.

3.3 Eligibility for Payouts: You must submit a valid W9 or W8 form to be eligible for commission payouts. Payouts are only made for completed sales through your referral link.

4. Intellectual Property

4.1 License: The Company grants you a limited, non-exclusive license to use its trademarks and promotional materials for the purpose of promoting the Company’s products and services.

4.2 Restrictions: You may not modify or create derivative works of the Company’s intellectual property.

5. Termination

5.1 Termination by Affiliate: You may terminate your participation in the Program at any time by providing written notice to the Company.

5.2 Termination by Company: The Company reserves the right to terminate your participation in the Program for any reason, including breach of these Terms.

6. Limitation of Liability

6.1 No Liability: The Company shall not be liable for any indirect, incidental, or consequential damages arising from your participation in the Program.

7. Modification of Terms

7.1 Amendments: The Company reserves the right to modify these Terms at any time. You will be notified of any changes via email or through the Affiliate Dashboard.
